In general, the provisions of the regulation apply to facilities including any institutional, commercial, public, industrial, residential structures or buildings containing condominiums or individual dwelling units operated as a residential cooperative, with greater than four (4) dwelling units. The asbestos NESHAP also applies to residential facilities with four (4) or fewer dwelling units which will be renovated or demolished as part of an urban renewal project or highway project.

Asbestos
In accordance with Section 112 of the Clean Air Act (CAA), the United States Environmental Protection Agency (USEPA) established the National Emission standards for Hazardous Air Polllutants (NESHAPs) to protect the public. Asbestos was one of the first hazardous air pollutants regulated under Section 112.

On March 31, 1971, USEPA identified asbestos as a hazardous pollutant, on April 6, 1973, USEPA first promulgated the Asbestos NESHAP regulations in 40 CFR Part 61, and on November 20, 1990, a revised NESHAP was promulgated by USEPA. In addition, the regulations requires owners/operators to notify the applicable State and local agencies and/or USEPA regional offices before demolition or renovation of a building occurs which contain a certain threshold amount of asbestos.
