Metallica 'sue over perfume name'
Metallica: Sued a cosmetics firm before over their name
Heavy metal band Metallica are said to be taking legal action against French cosmetics firm Guerlain over the name of one of their perfumes - also called Metallica.
The US group filed a trademark infringement suit against the company at the US district court for central California, according to Rolling Stone magazine.
They are reportedly demanding that Guerlain change the name of the scent on the grounds that it causes "confusion, deception and mistake in the minds of the public".
Metallica's lawyer, Jill Pietrini, told Rolling Stone the band decided to take legal action only after first sending a letter of complaint to Guerlain.
'Unfair competition'
Metallica settled a similar legal battle in January this year with Victoria's Secret who had given a line of lip make-up the same name as the band.
Guerlain's vanilla-scented perfume is a special edition release which has been on sale for past two months in the US, costing $175 for eight ounces.
Ms Pietrini told the magazine: "We sent a demand letter and haven't reached a resolution, so we had to sue," she said.
"They are advertising the perfume on web sites and on playbills in New York and we just can't have that."
Protecting copyright
Pietrini added that the band thought the public might believe they had sanctioned the perfume, and that calling it Metallica amounted to unfair competition and injury to their reputation.
Metallica have also previously taken legal action to protect their music.
The band sued the music-swapping Napster company for copyright infringement, claiming it had been illegally trading their songs.
Napster's software allows users to search for songs on MP3 and download them directly from one another's hard drives.
Although Metallica actively encourage fans to record bootlegs of their concerts, they believe there is a big difference between live recordings and high-quality digital copies of studio recordings being traded on the net.
